1. ACCEPTANCE OF TERMS

By accessing, using, or engaging our roadside repair services through this website ("Site") or by telephone, you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.

While each brand maintains distinct service offerings and customer interfaces, certain backend systems, payment processing, databases, and operational resources are shared across our network of service providers. This shared infrastructure allows us to provide efficient, cost-effective services while maintaining the highest standards of data security and service quality.

3. SERVICES PROVIDED

We provide emergency and non-emergency roadside assistance services including, but not limited to:

  • Vehicle towing and recovery
  • Jump-start services
  • Tire change and repair
  • Lockout assistance
  • Fuel delivery
  • Minor mechanical repairs
  • Winch-out services

Service Limitations:

Services are subject to technician availability, weather conditions, road accessibility, vehicle type, and local regulations. We reserve the right to decline service requests that pose safety risks or exceed our operational capabilities.

4. SERVICE AREA AND AVAILABILITY

Services are provided within our designated coverage areas as displayed on our website or communicated by our dispatch team. Service availability is subject to:

  • Technician availability
  • Weather and road conditions
  • Local traffic and safety regulations
  • Time of day and seasonal demand

Emergency services are prioritized based on safety considerations and service request chronology.

5. PRICING AND PAYMENT TERMS

Payment Processing:

All payments are processed through Stripe, Inc., a third-party payment processor. By using our services, you agree to Stripe's Terms of Service and Privacy Policy.

Pricing Structure:

  • Base service fees as quoted at time of service request
  • Additional charges for parts, materials, or extended service time
  • Mileage fees for services outside standard coverage areas
  • After-hours and holiday premium rates may apply

Payment Terms:

  • Payment is due upon completion of services
  • We accept major credit cards, debit cards, and electronic payments
  • Cash payments accepted at technician discretion
  • Returned payment fees: $35.00 or maximum allowed by law

6. LIABILITY AND INSURANCE

Service Limitations:

Our liability is limited to the actual cost of services provided. We are not responsible for:

  • Pre-existing vehicle damage or mechanical issues
  • Damage resulting from customer negligence or misrepresentation
  • Consequential damages including lost wages, missed appointments, or business interruption
  • Damage to modified vehicles or vehicles with non-standard equipment
  • Services performed on vehicles with gross vehicle weight exceeding our equipment ratings

USED TIRE AND TIRE PLUG DISCLAIMER - COMPLETE LIABILITY WAIVER

Customer expressly acknowledges and agrees that:

USED TIRES:

Any used, recapped, retreaded, or previously owned tires supplied or installed by us are PROVIDED "AS-IS" WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED. We make NO REPRESENTATIONS regarding the condition, remaining life, safety, or fitness for purpose of used tires.

Customer assumes ALL RISK and LIABILITY for the use of used tires including, but not limited to: tire failure, blowouts, tread separation, sidewall failure, loss of vehicle control, property damage, personal injury, or death.

Customer agrees to HOLD HARMLESS and INDEMNIFY us against any and all claims, damages, losses, or expenses arising from the use of used tires.

TIRE PLUGS AND EMERGENCY REPAIRS:

Tire plugs, patches, and emergency tire repairs are TEMPORARY SOLUTIONS ONLY and are not permanent fixes. Customer acknowledges that tire plugs may fail without warning and agrees that we bear NO LIABILITY for plug failure, tire failure following plug installation, or any consequences thereof.

Customer assumes COMPLETE RESPONSIBILITY for monitoring tire condition after plug installation and for seeking permanent tire replacement or professional repair at the earliest opportunity.

IMMEDIATE INSPECTION REQUIRED:

Customer agrees to have all used tires and tire plug repairs inspected by a qualified tire professional within 24 hours of service or before extended driving, whichever occurs first.

SPEED AND DISTANCE LIMITATIONS:

Customer acknowledges receiving verbal and/or written warnings regarding speed limitations (typically not to exceed 50 mph) and distance limitations for emergency tire repairs and used tire installations.

By accepting used tire installation or tire plug services, Customer WAIVES ALL CLAIMS against us and agrees that this waiver extends to our employees, contractors, agents, and affiliated companies.

This waiver applies regardless of the legal theory of liability, including negligence, strict liability, or breach of warranty.

Insurance:

We maintain commercial general liability and automotive liability insurance as required by law. Insurance certificate available upon request for commercial accounts.

Customer Responsibility:

Customer warrants that they are the vehicle owner or authorized agent and assumes responsibility for any damage not directly caused by our negligence.

7. INTELLECTUAL PROPERTY AND TRADEMARK COMPLIANCE

All content on this website, including logos, trademarks, service marks, text, graphics, and design elements, are owned by or licensed to us. Our brand names and logos are proprietary marks and may not be used without express written permission.

Third-Party Trademarks:

We respect intellectual property rights of others. Vehicle manufacturer names, model designations, and related trademarks are used solely for descriptive purposes and do not imply endorsement or affiliation.

8. PRIVACY AND DATA PROTECTION

Data Collection:

We collect and process personal information as detailed in our Privacy Policy, which is incorporated herein by reference. This includes:

  • Contact and location information for service delivery
  • Vehicle information for appropriate service matching
  • Payment information processed through our payment processor

9. GOOGLE ADS AND MARKETING COMPLIANCE

  • Accurate Representation: All advertising and marketing materials accurately represent our services, pricing, and availability. We do not engage in deceptive advertising practices.
  • Lead Generation: We may use various digital marketing platforms, including Google Ads, to connect with customers seeking roadside assistance.
  • Competitor References: Any references to competitor services or pricing are based on publicly available information and are not intended to mislead customers.

10. DISPUTE RESOLUTION

Governing Law:

These Terms are governed by the laws of Texas, without regard to conflict of law principles.

Arbitration Agreement:

Any dispute arising from these Terms or our services shall be resolved through binding arbitration under the rules of the American Arbitration Association, except for:

  • Small claims court matters under jurisdictional limits
  • Disputes involving trademark or intellectual property infringement
  • Emergency injunctive relief

Class Action Waiver:

You agree to resolve disputes individually and waive any right to participate in class action lawsuits.

11. FORCE MAJEURE

We are not liable for delays or inability to perform services due to circumstances beyond our reasonable control, including but not limited to: severe weather, natural disasters, government actions, labor disputes, equipment failures, or public health emergencies.

12. MODIFICATION OF TERMS

We reserve the right to modify these Terms at any time. Material changes will be posted on our website with updated effective dates. Continued use of our services after changes constitutes acceptance of modified Terms.

13. SEVERABILITY

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
